Recordable, Reportable or Neither?
When must a laceration be entered on the OSHA 300 log? When must a laceration be reported to Iowa OSHA? What information must be given to Iowa OSHA when self-reporting? How soon must an incident be recorded on the OSHA 300 log? Do the Iowa Worker’s Compensation laws and the OSHA recording regulations overlap? 

What does the OSHA log have to do with employee medical records?
Do I really have to keep my Safety Data Sheets for 30 years? Can safety data sheets potentially be considered medical records? Is my first aid log a medical record?

If you feel even a little unsure of answering these questions or if you are confused about medical records and maintenance times, you will want to attend this Recordkeeping workshop. Workshop activities include hands-on practice completing the log, using OSHA’s 3 key pieces of information to determine recordability and how to ensure that each potentially recordable incident is reported to you in a timely manner.

Workshop discussion will include first aid, employee involvement in your reporting system, and how to inform employees of their right to report work-related injuries, or illnesses, free from retaliation. The workshop will also include electronic reporting requirements, applicability, and updates to the standard. Attendees will also learn how to complete the OSHA 300, 301, and 300A forms and whose signature must be on the annual summary.

This year’s keynote speaker, who will kick off the Energy Conference’s first full day (March 2) – is Kent Stock. Teacher, coach, principal, husband, banker, parent, and powerful speaker, Kent is also the man who coached the 1991 Norway High School baseball team during their now-famous final season. As depicted in the 2007 film The Final Season, the nationally recognized Norway baseball team came together under inauspicious circumstances. They defied the odds under Kent’s leadership to win Norway’s 20th state title. To learn more about Kent, check out this video.

Pre-employment Investigations for Drug and Alcohol Program Violations

Beginning January 6, 2023, a pre-employment Clearinghouse query will satisfy the requirement to investigate a prospective driver's previous drug and alcohol program violations, as established by 49 CFR 391.23(e).

Employers of CDL drivers are required to conduct background investigations before hiring a driver. This process includes determining if the driver has violated the drug and alcohol regulations of any Department of Transportation (DOT) mode within the past three years (see 49 CFR 391.23(e)). Currently, this requires employers or their designated consortia/third-party administrators (C/TPAs) to conduct both electronic queries in the Clearinghouse and manual inquiries with previous employers to meet the three-year time frame.

Beginning January 6, 2023, when three years of violation data is stored in the Clearinghouse, prospective employers must not conduct manual inquiries. In accordance with §§ 382.413(b) and 391.23(e)(4), beginning January 6, 2023, prospective employers must conduct a pre-employment query of the Clearinghouse, as set forth in § 382.701(a), to comply with the inquiry requirement in § 391.23(e) as it pertains to FMCSA-regulated employers.

NOTE: The Clearinghouse contains only information about drivers employed by FMCSA-regulated employers. If a prospective employee was employed by an employer regulated by a DOT agency other than FMCSA (such as the Federal Railroad Administration, Federal Transit Administration, Federal Aviation Administration, etc.) during the three-year time frame, prospective employers will still be required to directly request drug and alcohol violation information from those DOT-regulated employers in accordance with 391.23(e)(4)(ii), since this information is not reported to the Clearinghouse.

Annual query requirements have not changed.
Employers of CDL drivers must conduct a query in the Clearinghouse at least once a year for each CDL driver they employ (see § 382.701(b)). This annual query requirement applies on a rolling 12-month basis, which means that if you conducted your last annual queries in December 2021, it is time to conduct the next round of annual queries.

Employers must obtain general consent from CDL drivers they employ before conducting limited queries in the Clearinghouse to view these drivers’ information (you can download a sample limited query consent form).

Jim Silvers Scholarship Awarded

​Last week during the 51st annual Iowa Governors Safety & Health Conference held in Altoona; Jim Silvers was honored.  Jim worked in the safety profession for 35 years in the state of Iowa.  He worked for the Iowa Association of Municipal Utilities, Iowa Illinois Safety Council, Hach Company, and the Pella Corporation.  He was affiliated with several community-based organizations.

​His wife, Maria, and son, Jordan, attended the awards ceremony to remember Jim and his passion for safety and care for others. We lost Jim in January of this year. He was an avid Iowa State University fan since his son went to ISU.   IAMU staff collected funds to offer a one-time $1,000 safety scholarship to an ISU safety student.  Tavion Yrjo was the winner of the scholarship and was very grateful.  He has been working on virtual reality (VR) technology to enhance employee safety, knowledge retention, and risk assessment skills.

IAMU Mobile Crane Operator Certification Classes - Final 2022 Dates

The Iowa Association of Municipal Utilities will be holding mobile crane certification and examination classes for digger derrick, service truck, and mobile crane operators.  OSHA’s updated crane standard REQUIRES that operators of lifting equipment be trained, evaluated and tested in order to obtain certification.

Background Information:
Although the new standard, 29 CFR 1926 Subpart CC, specifically exempts the digger derrick and the operator from meeting the requirements of the standard, the exemption applies only when it is used for work within the provisions of the power generation, transmission and distribution standards, or for construction work within the telecommunications standard.  The exemption does not apply if the digger derrick is used for lifting materials or to operate in working environments outside the scope of the standard because the equipment is essentially being used as a mobile crane.  For example, unloading materials from a truck, lifting a motor from a pump house to assist your water department, or providing assistance to any other city department will mean that the exemption no longer applies.  When equipment is used as a mobile crane, all provisions of the standard apply, including the operator certification rule.  OSHA also now requires that an operator be certified in specific areas when they operate equipment outfitted with a boom and winch and able to lift at least 2,000 pounds. This includes service trucks in your public works, or water departments.

The new standard has very specific operator requirements, one being to obtain operator certification from an independent testing organization accredited by a nationally recognized organization.  OSHA’s updated crane standard, 1926.1427 in Subpart CC, requires that for a testing organization to be considered accredited to certify operators, it must be accredited by a nationally recognized accrediting agency based on that agency’s determination that industry recognized criteria for written testing materials, practical examinations, test administration, grading, facilities/equipment and personnel have been met.  IAMU is an Accredited Assessment Center through the National Center for Construction Education Research (NCCER). We are authorized to conduct both hands-on assessments and practical examinations which are part of our Mobile Crane Operator Certification Program.  Additionally, we are offering Qualified Hand Signal Person and Qualified Rigger programs (available at a future date).

Who Should Attend:
Digger derrick and service truck crane operators who do not currently hold a mobile crane operator’s certification.

What Do These Classes and Certification Consist Of:
Classes will be a week long, requiring classroom instruction, an on-line exam that has a 80% pass requirement, a practical exam for certification of mobile crane, and then finally a short class and practical exam for the signalperson and rigging qualifications. Students who pass the written and practical exams receive nationally recognized certification from the National Center for Construction Education Research (NCCER).

  • There is a maximum of 10 participants per class session.
  • Lunch will be provided Monday through Thursday.
  • All participants will attend classroom days. Exams will take place on the Thursday of each class session. Depending on the number of participants, Wednesday evening and Friday may also be used for exams.
  • Each participant will need to create an account with NCCER before class; step-by-step instructions are included with the study guide.  Please bring your account number with you to class.
