IAMU has filed a lawsuit in Polk County asking the district court to review two of the IUB’s new electric service rules for municipal utilities in chapter 27. The lawsuit challenges two rules: (1) the rule requiring municipal electric utilities to provide notice of rate increases to all affected customers at least 30 days before the rate increase takes effect; and (2) the rule that says municipal electric utilities are prohibited from charging customers interest or late payment charges when they are making payments under a payment agreement. These rules went into effect on September 29, 2021. Challenging these rules is intended to keep the IUB from adopting rules that affect the ratemaking authority of municipal utilities.
